Any natural or legal person making a purchase via the website: www.maraboots.fr (hereinafter referred to as the “Website”).

Article 1 – Purpose

The purpose of these GTC is to define the conditions under which the Seller offers the sale of its products and/or services to the Customer via the Website.

Article 2 – Acceptance of the GTC

Any order placed on the Website implies the Customer’s unconditional acceptance of these GTC. They prevail over any other document.

Article 3 – Products and services

The products and/or services offered are those described on the Website on the day the Customer consults it. Descriptions, photographs, and illustrations are as accurate as possible but are not contractually binding.

Article 4 – Prices

Prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs.

The Seller reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is validated.

Article 5 – Order

The Customer selects the products they wish to purchase and validates their order after verification.

The sale is deemed final after:

validation of the order,

acceptance of payment,

sending of an order confirmation email.

Article 6 – Payment

Payment is due immediately upon ordering.

The accepted payment methods are: credit cards (VISA, Mastercard), PayPal, Google Pay, Apple Pay.

Transactions are secured via: CAWL Payment Solutions

Article 7 – Delivery

Products are delivered to the address indicated by the Customer when placing the order.

Delivery areas: [France / EU / international]

Indicative delivery times: between 3 and 5 days depending on the destination country and the chosen carrier.

The Seller cannot be held responsible for delays attributable to the carrier.

Article 8 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

Return shipping costs are borne by the Customer, unless otherwise stated.

Exceptions: the right of withdrawal does not apply to personalized products, downloaded digital products, or perishable goods.

Article 9 – Returns and refunds

In the event the right of withdrawal is exercised, the refund will be made within 14 days from receipt of the returned product or proof of shipment.

Returns policy:

Shoes must have been tried on indoors only and not worn outdoors to avoid any damage. Their condition must be identical to that at the time of shipment.

Shipping costs are borne by the Customer.

Article 10 – Warranties

The products benefit from:

the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code),

the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Article 11 – Liability

The Seller cannot be held liable for damage resulting from improper use of the purchased product.

The Seller’s liability cannot be engaged in the event of force majeure.

Article 12 – Personal data

Personal data collected is processed in accordance with applicable regulations and the Privacy Policy available on the Website.

Article 13 – Intellectual property

All elements of the Website are protected by intellectual property law. Any reproduction is prohibited without prior authorization.

Article 14 – Applicable law and disputes

These GTC are governed by French law.

In accordance with Articles L612-1 et seq. of the French Consumer Code, the consumer Customer may have free recourse to a consumer mediator for the amicable resolution of a dispute.

Article 15 – International sales, customs, and VAT

15.1 Geographic scope

Products are offered for sale in France, other European Union countries, and internationally.

15.2 Customs duties and taxes outside the European Union

For any order delivered outside the European Union, the Customer is informed that customs duties, local taxes, or import fees may be required by the authorities of the destination country. These costs remain entirely at the Customer’s expense and responsibility.

The Seller is not required to verify or inform the Customer of applicable customs duties and taxes in the country of delivery.

15.3 VAT

Sales destined for France are subject to applicable French VAT.

Sales to other European Union countries may be subject to the OSS VAT scheme in accordance with applicable regulations.

Sales outside the European Union may be exempt from French VAT, subject to proof of export.

15.4 International returns

In the event of a return from a foreign country, return shipping costs, customs duties, and any taxes remain the sole responsibility of the Customer. No refund of customs duties or taxes may be granted.

Article 16 – Applicable law and competent jurisdiction

These GTC are governed by French law.

Failing amicable resolution, any dispute shall be brought before the competent courts in accordance with common law rules.
